Les présentes conditions générales de vente (ci-après les « CGV ») régissent les relations contractuelles entre COCOCHARGE (ci-après le « Vendeur ») et ses clients (ci-après les «Clients ») pour la vente de produits (ci-après les « Produits ») sur le site internet de l’entreprise COCOCHARGE.FR (ci-après le « Site »). Le Vendeur se réserve le droit de modifier les présentes CGV à tout moment et sans préavis. Les CGV applicables à la commande sont celles en vigueur au moment de la passation de la commande.
These general conditions of sale (hereinafter the «GTC») govern the contractual relations between COCOCHARGE (hereinafter the «Seller») and its customers (hereinafter the «Customers») for the sale of products (hereinafter the «Products») on the website of the company COCOCHARGE.FR (hereinafter the «Site»). The Seller reserves the right to modify these GTCS at any time and without notice. The GTC applicable to the order are those in force at the time of placing the order.
L’acceptation de l’offre commerciale avec le versement d’un acompte (somme versée pour réserver le bien ou son équivalent) vaut commande. Le client peut revenir sur son engagement, l’acompte est perdu s’il annule sa commande. Les Clients doivent être âgés de plus de 18 ans et avoir la capacité juridique de contracter. Les informations fournies par le Client lors de la commande doivent être exactes et complètes. Le Vendeur ne pourra être tenu responsable en cas d’erreur de saisie par le Client. Le Vendeur se réserve le droit de refuser toute commande pour des raisons légitimes, notamment en cas de violation des présentes CGV, d’abus de droit ou de fraude.
The acceptance of the commercial offer with the payment of a deposit (sum paid to reserve the bike or its equivalent) is worth order. The customer can return his commitment, the deposit is lost if he cancels his order. Clients must be over 18 years of age and have the legal capacity to contract. The information provided by the Customer when ordering must be accurate and complete. The Seller cannot be held responsible in case of error of entry by the Customer. The Seller reserves the right to refuse any order for legitimate reasons, in particular in case of violation of these GTC, abuse of rights or fraud.
Les prix des Produits sont indiqués sur le Site COCOCHARGE .FR en euros, TVA non applicable – article 293 B du CGI (code général des impôts). Les frais de livraison sont à la charge du Client et sont indiqués avant la validation de la commande. Le paiement peut être effectué par virement ou tout autre moyen de paiement accepté par le Vendeur. Le Vendeur se réserve le droit de modifier ses prix à tout moment, mais les Produits seront facturés sur la base des tarifs en vigueur au moment de la validation de la commande.
The prices of the Products are indicated on the COCOCHARGE . FR Site in euros, VAT not applicable – article 293 B of the CGI (general tax code). The delivery costs are the responsibility of the Customer and are indicated before the validation of the order. Payment may be made by bank transfer or any other means of payment accepted by the Seller. The Seller reserves the right to change its prices at any time, but the Products will be charged on the basis of the rates in force at the time of validation of the order.
Les Produits seront livrés à l’adresse indiquée par le Client lors de la commande. Dans le cas ou l’adresse de livraison change à la demande du client, de nouveaux frais de livraison seront facturés en supplément. Le Vendeur s’engage à livrer dans les meilleurs délais après réception du paiement. Les horaires de livraison indiqués dans l’offre commerciale sont donnés à titre indicatif et ne sont pas garantis. En cas de retard de livraison, le Vendeur ne pourra être tenu responsable en cas de circonstances exceptionnelles, telles que les intempéries, évènements sportifs, les grèves, les problèmes de transport ou les cas de force majeure.
The Products will be delivered to the address indicated by the Customer when ordering. If the delivery address changes at the request of the customer, new delivery charges will be added at extra cost. The Seller undertakes to deliver as soon as possible after receipt of payment. The delivery times indicated in the commercial offer are indicative and are not guaranteed. In case of late delivery, the Seller cannot be held responsible in case of exceptional circumstances, such as bad weather, sporting events, strikes, transport problems or cases of force majeure.
Pour les locations, vous ne bénéficiez pas du droit de rétractation applicable pour les achats à distance (article L. 221-28 du code français de la consommation). Les acomptes versés via une facture d’acompte COCOCHARGE seront perdus en cas d’annulation. Pour les locations via ListnRide, les annulations sont gratuites jusqu'à 5 jours puis facturées 50% de la location jusqu'à 24h puis facturées 100% dans les 24h.
For rentals, you do not benefit from the right of withdrawal applicable for distance purchases (article L. 221-28 of the French Consumer Code). However, the payment in advance (deposit) will be lost. For rentals via ListnRide, cancellations are free up to 5 days then charged 50% of the rental up to 24h then charged 100% within 24h.
Le Vendeur garantit que les Produits sont conformes à la description sur le Site et qu’ils sont exempts de tout défaut de fabrication ou de matière. Tous nos vélos sont conformes à la réglementation française. En cas de non-conformité ou de défaut, le Client doit contacter le service clientèle du Vendeur dans les meilleurs délais pour signaler le problème. Le Vendeur remplacera ou remboursera le Produit défectueux, à son choix. La garantie ne couvre pas les défauts résultant d’une mauvaise utilisation, d’un accident ou d’une modification du Produit par le Client.
The Seller guarantees that the Products comply with the description on the Site and that they are free of any manufacturing or material defects. All our bikes comply with French regulations. In case of non-compliance or defect, the Customer must contact the Seller’s customer service as soon as possible to report the problem. The Seller will replace or refund the defective Product, at its option. The warranty does not cover defects resulting from misuse, accidents, or modification of the Product by the Customer.
Le Site et son contenu sont la propriété exclusive du Vendeur et sont protégés par les lois sur la propriété intellectuelle. Toute reproduction, représentation ou utilisation du Site ou de son contenu sans l’autorisation préalable du Vendeur est interdite et constitue une violation des droits d’auteur et de propriété intellectuelle.
The Site and its content are the exclusive property of the Seller and are protected by intellectual property laws. Any reproduction, representation or use of the Site or its content without the prior permission of the Seller is prohibited and constitutes a violation of copyright and intellectual property.
Le Vendeur ne pourra être tenu responsable en cas d’inexécution ou de mauvaise exécution du contrat en raison d’un cas de force majeure, tel qu’une guerre, une catastrophe naturelle, une grève ou une interruption des services de transport. La responsabilité du Vendeur ne pourra en aucun cas être engagée pour les dommages indirects, tels que les pertes de profit, les pertes d’exploitation ou les dommages immatériels.
The Seller shall not be liable in the event of non-performance or improper performance of the contract due to force majeure, such as war, natural disaster, strike or interruption of transport services. Under no circumstances may the Seller be held liable for indirect damages, such as loss of profit, operating losses or immaterial damages.

Les présentes CGV sont régies par le droit français. Tout litige entre le Vendeur et le Client sera soumis à la compétence exclusive des tribunaux français.
These GTC are governed by French law. Any dispute between the Seller and the Customer shall be subject to the exclusive jurisdiction of the French courts.
